1 Application of these Terms and Conditions

1.1 This citysearch.com.au; Website ("Website") is owned by CitySearch Australia Pty Ltd (ABN 48 076 673 587) ("CSA") and operated by Sensis Pty Ltd (ABN 30 007 423 912) ("Sensis") as agent for CSA. Your use of the Website is subject to these terms and conditions, the Sensis Privacy Statement and any other terms contained in the Website. By using the Website, You agree to be bound by these terms and conditions.

2 Intellectual Property

2.1 Except for the temporary copy held in the computer's cache and a single permanent copy retained by a user for his or her personal use, no content on the Website may be used, copied, reproduced, stored in a retrieval system, altered, or transmitted in any form or by any means in whole or part (except where such use constitutes fair dealing under the Copyright Act (Cth.) 1968).

2.2 The Website and the content on it are supplied for informational use. You must not reproduce, publish, make an adaptation of, or communicate, any of the content on the Website in any manner or in any form (whether visible or not) for any purpose whatsoever, except as permitted by clause 2.1.

2.3 CitySearch® is a registered trade mark of CSA.

2.4 The Sensis logo is a trade mark of Sensis.

2.5 Your use of the Website does not create a licence or any other rights with respect to the trade marks, service marks, copyright, or other intellectual property or proprietary rights in or on the Website.

3 Links to Third Party Websites

3.1 The Website contains links to websites operated by other parties ("Third Party Websites"). Sensis and CSA do not have a practice of monitoring or making inquiries about the content of websites accessed by such links. Subject to clause 5.2, Sensis and CSA are not responsible for, do not endorse and make no representations either expressly or impliedly concerning Third Party Websites, their content or any products or services which they offer. Content contained on Third Party Websites does not represent the views of Sensis or CSA. You access Third Party Websites completely at Your own risk.

4 Third Party Content

4.1 The Website contains content provided to Sensis and CSA by other parties ("Third Party Content"). Sensis and CSA do not have a practice of monitoring or making inquiries about Third Party Content. Subject to clause 5.2, Sensis and CSA are not responsible for, do not endorse and make no representations either expressly or impliedly concerning Third Party Content. Third Party Content does not represent the views of Sensis or CSA. You rely on Third Party Content completely at Your own risk.

5 Limitation of Liability

5.1 Except as set out in clause 5.2, Sensis, CSA and their respective contractors exclude all:

(a) warranties whether express, implied, statutory or otherwise, relating in any way to the Website or Your use of the Website; and

(b) liability (including for negligence) to You or anyone else in respect of any loss or damage (including special, indirect or consequential loss or damage such as loss of revenue, unavailability of systems or loss of data) arising from or in connection with any use of the information on or access through the Website (including, but not limited to Third Party Content and the Third Party Websites) for any reason whatsoever.

5.2 Where any law implies any term into Your use of or any arrangement arising out of the accessing of the Website and that statute prohibits exclusion of that term, then that term applies. If and to the extent permitted by that law, however, Sensis, CSA and their contractors' liability for any breach of such term is limited to the resupply of services.

6 Changes

6.1 Sensis may change these terms and conditions at any time without notice and You agree to be bound by such changes. Those changes shall be posted on the Website.

Terms & Conditions for Citysearch® iPhone App

These terms and conditions ("Terms") apply to your use of the Citysearch iPhone App and User Comments facilities provided by Citysearch Australia Pty Ltd ("we, us, our") through the Citysearch iPhone Application ("App"). If you do not agree to the Terms you must immediately stop using the comments facility.

1. The Terms may change - please read them carefully each time you use this App.

2. You acknowledge that if you download this App, other Facebook users may be able to see your location if you connect to Facebook through this App and 'check in' to a venue. We do not have control over who can see your location when you 'check in' using this App, and it is important that you control this through your own Facebook settings. If you have chosen to 'check in' to a venue, you will remain 'checked in' to that venue for 24 hours. If you do not want your location to be known you should not 'check in' to a venue. We may also use your location information to provide you with information relevant to your location. If you do not want this to occur you must delete the App.

3. You agree that we: (a) may publish any of the information you provide us through this App, including your name (your "Contribution") on the Citysearch.com.au website or App, at any time; (b) may alter your Contribution; or (c) may withdraw it from the Citysearch website or App for any reason, (d) if the withdrawn Contribution was also published on a third party site (eg. Facebook) and we think it is inappropriate, we may also notify that third party site; and (e) are not required to publish your Contribution.

4. Contributions should be more than one word and less than 1,000 characters and must only include text (and not any executable files).

5. In your Contribution you must: (a) only make comments based on your genuine personal experience; (b) only include information that is relevant, factually correct and can be proved; (c) support your opinion with explanation and examples where possible; (d) be candid, courteous and fair; (e) not make overly harsh or snide comments; (f) not include any content that is (in our sole opinion) inappropriate, including: (i) inappropriate language; (ii) information that could be used to identify you (other than your name) or any other person; (iii) commercial material, including comments that advertise other websites (iv) any unlawful material; (v) copyright content without permission of the owner; or (vi) material that refers to a person under 18 years old.

6. If you "connect with Facebook" or any other third party site facilitated by us, your Contribution will be published on that third party site and you must comply with the terms of that third party site.

8. You must tell us if you no longer hold the views expressed in your Contribution or if you do not agree with any changes we have made to your Contribution.

9. You promise that: (a) you are at least 18 years old; (b) you are not associated (as a friend, relative, employee, employer or contractor) with any of the entities referred to in your Contribution, or their related entities; (c) you have not received benefit from the entity referred to in your Contribution, or its related entities; and (d) your Contribution does not contain any programming bugs or computer viruses that may interfere with any system or data.

10. We are not responsible for the actions of unauthorised third parties who access your Contribution and other information about you.

11. You indemnify us for any loss we suffer as a result of your use of this App.

12. We exclude all liability to you in respect of this App to the extent that it may be excluded at law. If any liability cannot be excluded, but can be limited under any legislation, our liability is limited to the maximum extent permitted.

13. We may collect, use and disclose your personal information in accordance with the practices set out in our Privacy Policy (available at http://about.sensis.com.au/legal/privacy.php or by calling 1800 039 059).
